In the recent decision of Moran v. Illinois Workers’ Compensation Commission (Village of Homewood), 2016 IL App (1st) 151366WC, the Illinois Appellate court found that a firefighter, who had witnessed the injury and death of a fellow firefighter at the scene of the incident, proved entitlement to benefits for the development of post traumatic stress, even though the claimant was not physically injured. This is an important decision as it affirms the rights of workers who “suffer a sudden, severe emotional shock traceable to a definite time, place and cause which causes psychological injury or harm…”.
